COOKIES AND WEB POLICY PURSUANT TO REGULATION (EU) 679/2016 ON THE PROTECTION OF PERSONAL DATA

The purpose of this “Cookie and Web Policy” is to describe the management methods of the website of Gilardoni S.p.A. a Socio Unico (hereinafter GILARDONI), with regard to the processing of personal data of users who consult it.
This information is provided, pursuant to Art. 13 of Regulation (EU) 2016/679 on the protection of personal data (hereinafter referred to as “the Regulation”), to those who interact with the GILARDONI Website by electronic means and use the related services from the address: “https://www.gilardoni.it/“.
The information is provided only for the sites mentioned above and not for other Websites that may be consulted by the user through special links.
This information is an integral part of the website and services offered by GILARDONI.
Access to the website and its use are based on the assumption that this Policy has been read and understood: if you do not agree with what is contained in this policy, we ask you to kindly not use our website. GILARDONI reserves the right to modify or simply update, in whole or in part, this Policy. Any changes or updates to it will be available to all users in the Privacy section of the website as soon as the updates are active. Updates are binding as soon as they are published on the GILARDONI website: if the User does not accept such changes and/or updates, he may stop using our website.

2. CATEGORIES OF PERSONAL DATA

For the purpose of managing its website, GILARDONI collects and processes the following personal data of users who consult it:

  • Other parameters related to the operating system and the computer environment of the user.

This data is used only for the purpose of obtaining anonymous statistical information on the use of the site and to check its correct functioning and are deleted immediately after processing. The data may be used to ascertain liability in case of hypothetical computer crimes against the website.

For the GILARDONI website and its subdomains cookies are used, asking the user’s consent where the law or the applicable regulations so provide, to facilitate navigation and customize the information addressed to the user.

2.3. E-MAIL ADDRESSES

If users, by connecting to this website, send their personal data to access certain services (e.g. newsletter, service “work with us”, etc.), or to make requests to GILARDONI by e-mail, this involves the acquisition by the Company of the sender’s address and/or any other personal data that will be processed exclusively for the purposes indicated in this declaration. Your data will be processed for purposes related to the fulfillment of your specific requests, contractual, fiscal and accounting obligations; history and billing; litigation and credit protection; fulfillment of obligations provided by current laws.

2.4. PERSONAL DATA PROVIDED VOLUNTARILY BY THE USER

Apart from what is specified for navigation data, users are free to provide GILARDONI with their personal data. Failure to provide them can only make it impossible to obtain the services requested. Therefore, visitors are able to navigate the website even without disclosing information and personal data.
Once registered, the personal data collected will be used only for the purposes indicated in this statement and by personnel specifically appointed, in compliance with the current rules and according to the normal internal procedures defined by the Company.

2.5. SECTION “SANITIZING OBJECTS FROM VIRUSES AND OZYGIL BACTERIA”

Allows the user to pre-order the OZYGIL product.
To use this service, the user is required to provide the following data (including personal data) that may refer to natural or legal persons: name, surname, country, company name, e-mail.

2.6. SECTIONS “TECHNICAL ASSISTANCE” AND “RESTRICTED AREA”

They allow the user to monitor Technical Assistance activities in real time, to check the progress of open tickets and related orders. In addition, from the portal you can check the progress of maintenance and testing. For the use of this service, the user is not required to provide personal data.

2.7. SECTION “CONTACT US”

Allows the user to send messages, communications or requests for information to GILARDONI.
For the use of this service, the user is required to provide the following data (including personal data) that may refer to natural or legal persons: name, surname, company name, category (e.g. company, private, etc.), country, city, telephone, e-mail, type of requests (e.g. information, commercial, etc.), message contents.

2.8. SECTION “NEWSLETTER”

It offers the user the possibility to receive commercial communications related to the products and offers of the Company.
The data required for this purpose, under penalty of exclusion from the service, are the following: name, surname, country, company, e-mail.

2.9. SECTION “SELF-APPLICATION”

It allows the user to send to GILARDONI their Curriculum Vitae to apply for jobs open at the Company. To use this service, the user is required to provide the following personal data relating to natural persons: name, surname, residence (e.g. address, location, state, province, region, postal code, country), date of birth, place of birth, tax code, e-mail, telephone, mobile phone, licence, training (e.g. qualification, year of achievement, grade), professional experience (e.g. start and finish date, sector, company name, activity description, RAL, reason for change), language skills, IT skills, enabling forklift use, knowledge of CNC machines, use of measurement instrumentation, ISO 9001 knowledge, training certifications (e.g. T.U. 81/01), availability to international transfers, other skills, reason for application, area of interest, Curriculum Vitae (in Annex).

2.10. SECTION “SUPPLIER AREA”

Allows Companies (legal persons) to enter the information necessary to qualify as a Supplier of GILARDONI. For the use of this service, the user is required to provide the following data (including personal data) that may refer to natural or legal persons: company name, address of the Headquarters/operations, e-mail, fax, Website, description of the activity carried out, type of activity, contract information (e.g. name, surname and role of internal Referents), payment terms, staff, turnover, ISO 9001 certifications, standards and standards adopted.

3. PURPOSE OF PROCESSING

The data in question will be processed only for the purposes declared by the Company, for the fulfilment of obligations and for the exercise of the rights provided by law. The processing of personal data of data subjects is carried out in accordance with the purposes and legal bases listed below.

3.1. CUSTOMER SERVICE MANAGEMENT

Description
Personal data collected through the “CONTACT US” section of the Company Website are processed for the purposes of managing and performing the customer service, intended as the provision of services to Customers before, during and after the purchase of a GILARDONI product aimed at increasing the level of customer satisfaction (e.g. maintenance management and technical assistance).
Legal bases
The processing is carried out on the basis of specific legal bases: the consent (specific, informed and unequivocal) of the data subject, the performance of a contract of which the data subject is part (purchase) and the fulfilment of legal obligations to which the Data Controller is subject.

3.2. RECRUITMENT AND RECRUITMENT

Description
The personal data collected through the “self-application” section of the Company Website are processed for the purposes of managing the application evaluation process for the purpose of establishing an employment relationship with the Company. The processing is necessary for the execution of pre-contractual measures taken at the request of the candidate and is mandatory and essential for the performance of the contract, with the consequence that any refusal to provide them would completely preclude the Company the possibility of evaluating the application.

3.3. SENDING COMMERCIAL COMMUNICATIONS

Description
The personal data collected through the “NEWSLETTER” section of the Company Website are processed for marketing purposes or for the transmission of communications (by e-mail, fax, paper mail, SMS and MMS) of an informative and commercial nature, advertising material, newsletters and promotional initiatives related to the activities, products and services offered by GILARDONI.
Legal bases
This processing is carried out on the basis of specific legal bases: the consent (specific, informed and unequivocal) of the data subject, whether it is a natural person or a legal person.exclusively for the purposes of managing contacts and business relations.

3.4. QUALIFICATION OF SUPPLIERS

Description
Personal data collected through the “SUPPLIERS AREA” section of the Company Website are processed for the purposes of qualification of GILARDONI Suppliers.
Legal bases
This processing concerns information relating to Companies (legal persons), to which the rules on the protection of personal data provided for by the Regulation do not apply. The same applies to any personal data relating to the Company Contact Persons (name, surname and role), processed only and exclusively for the purposes of managing contacts and business relations.

3.5. PRE-SALE OF SPECIFIC PRODUCTS

Description
The personal data collected through the section “SANITIZING OBJECTS FROM VIRUSES AND BACTERIA OZYGIL” of the company Website are processed for the purpose of managing the pre-sales of specific products of GILARDONI.
Legal bases
This processing is carried out on the basis of specific legal bases: the consent (specific, informed and unequivocal) of the data subject and the execution of pre-contractual measures taken at the request of the data subject.
It is however always possible to ask the Data Controller to clarify the concrete legal basis of each processing and in particular to specify whether the processing is based on the law or provided for by a contractual obligation to which the data subject is a party.

4. METHODS OF PROCESSING

Your personal data, necessary for the achievement of the purposes referred to in “Paragraph 3 – Purposes of processing”, are collected, recorded, organized and stored in electronic and/or paper archives.
Your personal data may be processed either by paper media, or with the help of electronic tools equipped with security measures to ensure respect for the rights of the data subject as well as confidentiality, the integrity and availability of the data processed, in accordance with the Regulation.
The data collected by GILARDONI are not subject to profiling, or an automated processing performed on personal data for the purpose of evaluating particular characteristics of a natural person (e.g. analysing or forecasting aspects relating to the professional performance, economic situation, health, personal preferences, interests, reliability, behaviour, location, movements of that natural person, etc.).

5. MANDATORY OR OPTIONAL NATURE OF THE PROVISION DATA

Users are free to provide GILARDONI with their personal data: failure to provide them can only make it impossible to obtain the services requested.
The provision of personal data is necessary for the purposes referred to in points 1), 2), 3) and 5) of “Paragraph 3 – Purposes of processing”: the lack of such provision may make it impossible for the Company to achieve the stated purposes. Your consent is required for their processing.

6. CATEGORIES OF RECIPIENTS OF PERSONAL DATA

Your personal data will not be disclosed, with this term meaning to give information to indeterminate subjects in any way, including through their provision or consultation.
Your personal data will be communicated, only and exclusively for the achievement of the purposes indicated in “Paragraph C- Purposes of processing”, to the GILARDONI Corporate Functions in charge of processing them or to those who act under the authority of the Company as Data Processors and who need to process them for the performance of their duties or by virtue of the position that cover (e.g. hierarchical superiors, persons working in the human resources function, other business functions that may need its performance, etc.).
These Data Processors, whose number will be as contained as possible, will have access to the only data relevant to the activity assigned to them and will act on the basis of instructions provided by the Company to that effect. For the same purposes, the data may also be made available to the Data Processors belonging to the Group.
Without prejudice to communications made in compliance with legal and contractual obligations, your personal data may also be transmitted to the following categories of recipients, which the Company uses to achieve the purposes indicated in “Paragraph C- Purpose of processing”:

  • Professionals or service companies that take care of the execution of specific phases of the commercial communication service provided by GILARDONI;
  • Third party companies or consultants in charge of the installation, maintenance, updating and in general, the management of the hardware and software of GILARDONI.

Such recipients, should they process data on behalf of GILARDONI, will be appointed as external Data Processors by means of a special contract (or other legal act) that will bind them to the Company and will provide the guarantees prescribed by Art. 28 of the Regulation to protect the rights and freedoms of the data subject.
Finally, please note that any information concerning you may be accessible (directly or indirectly) to professional figures that the Company has identified on an individual basis and has expressly designated as System Administrator: it is technical personnel whose activity is aimed at the management and maintenance of the data processing system or its components (e.g. to supervise the resources of the operating system of a computer or a Database and to allow its use, to manage the credentials of access to the systems, to organize the flows of net, to effect the back ups, to adopt measures of protection, etc.).

7. LOCATION AND TRANSFER

Your personal data are processed at the offices of the Data Controller and in any other place where the parties involved in the processing are located. In order to achieve the purposes referred to in “Paragraph C – Purposes of processing”, your personal data will not be transferred to third countries outside the European Union or to international organizations.

8. RETENTION PERIOD OF PROCESSED DATA OR CRITERIA USED TO DETERMINE THAT PERIOD

The personal data processed by the Company will be kept until the end of the purpose for which they were collected and subsequently processed. It is specified that:

  • Your personal data, processed for the purpose of managing the customer service, will be kept and processed by the Company until you request cancellation, to be made;
  • Or by sending a written communication to the contact details indicated in this statement;
  • Or using the procedures for disabling the service expressly provided for by the platform used, accessible through the GILARDONI Website.
  • Your personal data, processed for the purposes of research and selection of personnel, will be kept by the Company up to a maximum of 5 (five) years from the time of collection;
  • Your personal data, processed for the purpose of sending commercial communications, will be kept and processed by the Company until you request the termination of the service, to be carried out:
  • Or by sending a written communication to the contact details indicated in this statement;
  • Or using the appropriate link for the deactivation of the service, reported at the bottom of each commercial communication sent by GILARDONI.
  • Your personal data, processed for the purpose of pre-sales of specific products, will be kept and processed by the Company until you request cancellation, to be made by sending a written communication to the addresses indicated in this statement.

GILARDONI may retain some of the collected personal data for as long as necessary to satisfy its legitimate interests, such as fraud prevention and security promotion.
Furthermore, GILARDONI may be obliged to keep part of the personal data collected for a longer period, in compliance with legal or contractual obligations.
Because GILARDONI adopts solutions to protect its website from accidental loss or data theft, residual copies of your personal information may, for a limited period of time, not be removed from our backup systems. At the end of the retention period, personal data will be deleted (unless otherwise indicated by the interested party): for this reason, upon reaching this deadline, the right of access, erasure, rectification and portability of personal data can no longer be exercised.

9. RIGHTS OF THE DATA SUBJECT

You have the right at any time to exercise the rights recognized by the Rules. In particular, you have the following rights:

  • Know the purposes and methods of processing, the logic applied in the case of processing carried out by electronic means, the identifying details of the Data Controller and the Data Processors, the subjects or categories of subjects to whom the personal data may be disclosed or who may become aware of them in their capacity as managers or agents;
  • Obtain the updating, the rectification or (when the interested party has interest) the integration of data, the cancellation, the transformation into anonymous form or the blocking of data processed in violation of the law, including those for which storage is not necessary in relation to the purposes for which the data were collected or subsequently processed, proof that the said operations have been brought to the attention of, including as regards their content, of those to whom the data have been communicated or disseminated, except where such performance proves impossible or involves the use of means manifestly disproportionate to the protected right;
  • The right to object, in whole or in part, for legitimate reasons, to the processing of personal data concerning him, although relevant to the purpose of the collection and processing of personal data relating to him for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication;
  • Request copies of the personal information held by the Company in a commonly used and machine-readable format and/or the right to request the transmission of such information to another service provider (where technically feasible);
  • Make complaints about the personal data processing activities carried out by the Company at the Data Protection Authority.
